Are you achieving your true entitlement on interim Applications for Payment and Final Account agreements?

Do you have the resource of a Quantity Surveyor?

Are you a Subcontractor in the construction industry, and do not currently have a Quantity Surveyor resource as part of your team?  Do you find yourself not achieving your true entitlement with Interim Applications for Payment and Final Account agreements?  If the answer to either or both of these questions is ‘yes’, then TempTask can help.

Are You Achieving your Entitlement?

Any experienced and time served Main Contractors’ Quantity Surveyor will recount you with numerous tales of subcontractor Applications for Payment and Final Account submissions being substandard.  The root cause of this is, more often than not, the subcontractor not having the resources of a Quantity Surveyor to prepare and submit their assessments in the proper format, language and in a timely manner as required contractually, and by statute.

As a minimum, this is a headache for the Main Contractors’ Quantity Surveyor, entailing additional undue and unwarranted workload in properly assessing the amount due to the Subcontractor, and promoting an uncollaborative approach with a lack of professionalism and commercial appreciation.

More pertinently, any Subcontractor not properly and timeously presenting their Interim Application for Payment or Final Account assessment may be exposed to potential under recovery against their true entitlement, with possible under recovery due to inaccurate quantities measurement, incorrectly employing change evaluation mechanisms, or being time barred against the contractual ticking clock.  Essentially, the old adage ‘if you don’t ask, you don’t get’ acutely applies.

The maximum potential fall out of a failure by a Subcontractor to properly present and submit their assessment could result in invalidity of the Application for Payment or Final Account assessment, rendering it void and ineffective, as borne out by recent case law.

How to Achieve Your Entitlement

There are no guarantees that you will achieve your entitlement, as many factors come in to play, but there are steps that you can take to assist in reaching this goal.

Quantity Surveyors are unique animals.  They speak the same distinct language.  They like information to be presented in a familiar, readily identifiable format and in sufficient detail to easily identify how an evaluation has been derived in order to properly assess amounts properly due.  They understand Contract terminology, and the mechanisms that are required under the Contract.

Engage a likeminded Quantity Surveyor as your representative to prepare, produce, submit and manage your next Application for Payment or Final Account submission and avoid these pitfalls.
